Acceptance of Terms

Welcome to AI-PFP. These Terms of Service apply when you access, register for, purchase, or use the AI-PFP website, image generation tools, account features, and related services.

By using AI-PFP, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree with any part of these Terms, please do not use our services.

AI-PFP is an AI-powered image generation service that allows users to upload photos, submit prompts, and generate avatars, headshots, and other related visual content. We may continuously adjust, update, suspend, or optimize certain features, models, plans, pricing, or availability, and we do not guarantee that any specific feature will remain available permanently.

Eligibility and Accounts

You may need to create an account to access certain features of AI-PFP. You agree to:

Provide true, accurate, and complete registration information
Keep your account information updated so that it does not become outdated or misleading
Safeguard your login credentials and remain responsible for activities under your account
Notify us promptly if you become aware of unauthorized use of your account or any security issue

If we reasonably believe that your information is false, your use presents abuse risk, or you have violated these Terms, we may limit, suspend, or terminate your account or access to part of the service.

User Content

When using AI-PFP, you may submit photos, profile images, reference images, text prompts, parameter settings, or other materials (collectively, "User Content"). You retain any rights you lawfully hold in your User Content, but you represent and warrant that:

You have the right to upload, submit, and use that User Content
The User Content does not infringe any third party's intellectual property rights, privacy rights, publicity rights, or other lawful rights
The User Content does not violate applicable law and does not include unlawful, infringing, harassing, hateful, fraudulent, or otherwise abusive material that we prohibit

To enable AI-PFP to operate the service, you grant us a non-exclusive, limited, revocable license, solely as necessary to provide, maintain, improve, and protect the service, to host, store, reproduce, process, transmit, and display your User Content.

Generated Results

AI-PFP generates images or other output based on User Content and system processes. Except as otherwise limited by applicable law, third-party rights, or platform rules, you may generally use the generated results made available to you in the ways permitted by our service.

You understand and agree that:

Generated results may not be unique, and other users may receive similar or identical outputs
We do not guarantee the accuracy, completeness, usefulness, originality, or fitness of generated results for any particular purpose
You are responsible for evaluating whether generated results are appropriate, lawful, and non-infringing before publishing, commercializing, advertising, branding, or otherwise relying on them in important contexts

Acceptable Use

You agree not to use AI-PFP to:

Violate any applicable law, regulation, or third-party rights
Upload, generate, or distribute unlawful, infringing, harassing, hateful, pornographic, fraudulent, misleading, malicious, or otherwise improper content
Impersonate another person or use another person's photos, identity information, or protected content without authorization
Probe, scan, disrupt, bypass, or interfere with platform security mechanisms, rate limits, or access controls
Abuse the service, models, or infrastructure through automation, scraping, bulk misuse, reverse engineering, or other improper means unless we expressly permit it
Resell, sublicense, replicate, mirror, or otherwise exploit AI-PFP services, code, content, or output capabilities without authorization
Use the service for spam, fraud, harmful deepfake misuse, or other activities that may harm individuals, organizations, or the public

If we reasonably believe your use creates risk, violates the law, infringes rights, or harms the platform or others, we may take measures including removing content, restricting features, suspending service, or terminating your account.

Paid Features, Subscriptions, and Refunds

Some AI-PFP features may require payment, credit purchases, or subscriptions. You agree to:

Pay the fees shown on the applicable page in accordance with the displayed pricing, billing cycle, and payment terms
Provide valid payment information to us or our payment providers and authorize the applicable charges
Accept that recurring products may renew automatically according to the rules shown on the purchase page, subscription page, or payment terms unless you cancel before the next billing cycle begins
Understand that paid fees are generally non-refundable unless required by applicable law or expressly promised on the purchase page; however, for a first-time subscription purchase, if you are dissatisfied with the service, you may submit a refund request within three (3) calendar days after the subscription start date by contacting support@ai-pfp.com. We may review the request based on applicable law, account usage, material service consumption, and fraud, abuse, or refund risk. Renewal charges are generally not eligible for this three-day refund policy

We may change pricing, plan structure, free allowances, or billing methods at any time, but we will provide reasonable notice for changes that apply going forward.

Intellectual Property

Except for User Content and materials lawfully owned by third parties, AI-PFP and its website, interfaces, branding, software, model integration workflows, documentation, and related content are owned by us or our licensors and are protected by law.

Except as expressly permitted in these Terms, these Terms do not transfer any AI-PFP intellectual property rights to you. You may not copy, modify, distribute, sell, lease, decompile, reverse engineer, or create derivative works from AI-PFP without authorization.

Privacy

We handle your personal information in accordance with our separate privacy policy. By using AI-PFP, you understand and agree that we may collect and process relevant information as described in our Privacy Policy.

Service Availability and Changes

We work to keep the service stable, but we do not guarantee that AI-PFP will always be uninterrupted, error-free, or fully secure. We may modify, limit, interrupt, or discontinue part or all of the service at any time due to maintenance, upgrades, security, compliance, changes in third-party dependencies, or other operational reasons.

Termination

You may stop using AI-PFP at any time. We may also limit, suspend, or terminate your access to some or all of the service if:

You violate these Terms of Service
We reasonably suspect fraud, abuse, security risk, unlawful conduct, or infringement issues
We receive a valid complaint, legal demand, or regulatory instruction
Continuing to provide the service to you may create risk for AI-PFP, other users, or third parties

After termination, provisions relating to payments, liability limitations, dispute resolution, intellectual property, and other terms that should survive by their nature will remain in effect.

Disclaimer

AI-PFP is provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, we disclaim all express and implied warranties regarding the service, generated results, and related content, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, timeliness, security, and uninterrupted availability.

Limitation of Liability

To the fullest extent permitted by applicable law, AI-PFP and its affiliates, officers, employees, agents, partners, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the service, nor for any loss of profits, revenue, data, goodwill, business interruption, or cost of substitute services.

If applicable law does not allow full exclusion of certain liabilities, our liability will be limited to the maximum extent permitted by law.

Indemnification

You agree to indemnify, defend, and hold harmless AI-PFP and its affiliates from and against any claims, losses, liabilities, damages, judgments, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your violation of these Terms, your User Content, your manner of using the service, or your infringement of any third-party rights.

Governing Law and Disputes

These Terms will be interpreted in accordance with the applicable laws of the jurisdiction in which the AI-PFP operating entity is established, without regard to conflict of law rules. Any dispute arising out of or relating to these Terms or the service should first be addressed through good-faith discussions. If a dispute cannot be resolved informally, it may be submitted to a court, arbitral body, or other legally competent dispute resolution forum, as determined by applicable law and the relevant operating arrangement.

Updates to These Terms

We may update these Terms of Service from time to time. The updated version will be posted on this page and will become effective when posted or on any later date stated on the page. Your continued use of AI-PFP after an update generally means that you accept the revised Terms.
